Manufacturing, Distributing or Dispensing Controlled Dangerous Substance

We represent clients charged with N.J.S.A. 2C:35-5; New Jersey controlled dangerous substance - CDS - indictments filed in Middlesex County, Monmouth County, Mercer County, Somerset County, Essex County, Union County, and Hudson County.

The penalty for this offense is dependent on the type of substance involved and the quantity.

The state must prove that the defendant knowingly or purposely - purposely means that the conscious object of the defendant to manufacture, distribute or dispense CDS - manufactured, distributed or dispensed the substance.

The state must also prove that the defendant was aware of the character of the substance to prove knowingly.

The state must prove three elements.

First, the item is a CDS.

Second, defendant manufactured, dispensed or distributed it.

Third, defendant acted knowingly or purposely.
